The Sexual Offences Act 2003 made these offences of extra-territorial jurisdiction, meaning that the English law applies to Mark Williams Thomas (I am assuming that he is a UK citizen, not a - for example - South African expat).

(Case law) would suggest that a UK citizen commits the English offence even though inciting a person subject to foreign law (which may or may not criminalise the activity in question)). However, it would subvert the intention of PCA1978 (as amended by SOA2003) if the person incited to show ALSO had to be subject to English law. So I expect that the courts would conclude that a UK citizen asking a (normal) French citizen to show an indecent photograph would be liable to prosecution in England whether or not the French citizen would break French law by showing it. If the French police have no lawful reason to show, then Mark Williams Thomas has no lawful reason to request the showing, so he is guilty of incitement.

If his cameraman (or himself) filmed in such a way that the video was recorded, the camera operator (with MWT as an accomplice) would commit the offence of ‘taking an indecent photograph’, to which there is NO defence (not even for the police). French police would be (theoretically) guilty of ‘permitting the taking’ of the indecent photograph recorded on the video (to which there is no defence). If such recording DID contain (despite there being no intention to transmit) the indecent photograph, bringing the video into the UK would be an offence under the Customs Acts. Possessing the video would be an offence (s.160). Editing the video in a way that replicated the video would be a separate offence of making a copy (whether digital or not).

Views to this thread have gone up to THREE (including this one). The Arab Spring thread has, in similar time, had 1134 views. Without Headline-Including Random CAPitals and hyphens bent-media.
