The Cat I would guess that if they were given a caution it's because there was not enough evidence for a successful prosecution. I heard one lawyer say, on TV, that this is why nobody should ever accept a caution, especially if they are innocent. Insist on your day in court. However, I have also come across court cases where the prosecution failed to offer any evidence to support their case yet still managed to win.

Then there's the recent sentences for those three online users who discussed child rape.

I find the blurring of the line very troubling. Whilst everyone, rightly, wants to prevent and punish abuse, it is getting dangerous when people are locked up for fantasies or even jokes.
