Biden is probably still waiting for the second debate with Trump.

But think about the baseball caps and merchandise emblazoned with 45 - 47 on them.
Can you just imagine, not resigning but quite possible after all this if Biden did expire before January 20th and Kamala became 47th for a few weeks to serve it out. Some of the craziest imagineable things have happened in politics in the past 10 years so why not this.
Pardons I believe are often done in January shortly before an outgoing President leaves office. Biden's could be interesting.

I think the charges he was convicted of were state so it would need the Governor who has the power to pardon him.
I think it would have been a good idea (and Biden should pardon his son) as the legal battles seemed to have sent Trump insane in his quest for retribution.
Remember the Supreme Court has basically said a president can't break the law so Trump is home free now.
But that also means Biden can't break the law so that sort of nips in the bud Trump pursuing Biden as he has threatened.
Biden should resign and let Kamala Harris be president for 2 months just for the heck of it.

Wouldn't the cleverest thing Biden could do before he leaves office in January be to pardon Trump for the conviction he has been given, in the name of national unity and moving forward with less rancour? The former President and now President-elect still faces showing up in court later this month for sentencing. Is that really still in the national interest now? It's obvious to everyone that the charges were politically motivated to derail his Presidential return, and that has comprehensively failed. Other pending cases are now likely to be dropped anyway when Trump enters office.
It's probably too clever by half for this current set of Democrats and Biden to consider doing a pardon, not to serve Trump's own personal interests but to serve the nation's national interest.
