You are absolutely right. The US has done all it can to "pretend" that those it holds (illegally) are not priwsoners of war, so they can concoct some kind of kangaroo court that has no legitimacy.
To now admit that they are pow's opens the door to war crimes from breaches of the Geneva Convention.

Which "war" are they referring to? Bush would tell us that troops in Iraq and Afghanistan are putting down an insurgency, dealing with terrorists. This does not amount to a war in any real sense. If Bush calls himself a "War President" then he is technically giving some form of legitemacy to those he is fighting. Plus, if this is a war, he must treat those he captures in accordance with the Geneva Convention.

The plan to hold lynchings and kangaroo "courts" at Guantanamo has been ruled unlawful by the US Supreme Court.
This is a major blow for the US President - and is the first time ever that the US Supreme Court has over-ruled a sitting President in "war-time".
