This deserves its own thread; a question posed by Hedda elsewhere. We watch the compensation culture kick in; but what about those libeled or damaged by false claims and allegations?

Take Freddie Starr or Gary Glitter.

If the claims against them cannot be proved and any prosecution dropped, surely there's a case for them to sue the papers and the liars?

Defence will be "I genuinely believed it". The reply must be "well you shouldn't have".

When, during my trial, one man swore on oath in the witness box that he'd had long discussions about compensation with the investigating police officer - she was not allowed in court (like the other police).

So she didn't know this when she, in the box at the Old Bailey, swore on oath that she had not discussed compensation with any of the complainants.

At the time I asked my lawyers to report her for perjury. They roared with laughter.

And said the Judge would point out the discrepancy in his summing up.

He didn't.

Apart from wondering about the incompetence of the police (surely a spy in the public gallery should have tipped her off?), I was - and remain - outraged.

Both at the incompetence of my own lawyers and at the unfairness of the system. The judge should have stopped the trial then and there.

False accusers think that if their victims are dead, they can lie with impunity, and perhaps they can. But living victims should be able to sue the arse off them and put in criminal claims too.

Certainly I think Fred Starr has a case if the allegations are not proved or shown to be blatantly false and from Ms Raccoon's writings, this could be true.

GG?..possibly not a libel case there must be protection from people who attempt to get you jailed on falsehoods.

re :: GG and our Thai tabloid reporter. He has a piece on his website about his brilliant capture of GG but has inadvertently written how he and NOTW photographer entered countries on false visa..now inexplicably removed from the story. He regularly attacks Brit ex-pats for visa irregularities.

Now I hear that Pattaya business heavyweights are up in arms as they have been presented with a folder of said hack's tales in British newspapers...and they are so derogatory about Thailand and not an image he presents on his website. I'd be very surprised if he wasn't deported.
I've lost the website but it will re-appear- someone has gotten a statement from a Hong Kong Immigration official that says they were bribed by NOTW hack to give them access to GG.

Imagine the story.

70s Pop Icon today, took Police, Newspapers & so called "abused" fans to the cleaners, as he managed to win libel court case & was awarded 1.5million in damages.
Mr Gadd aged 68(appearing on Panorama next Monday)said "I was simply appaud at the way I was hounded by the press, over this. It was a complete conspiracy. I will now be putting on a charity concert, with the money, I've collected & it will be donated to all my fans, that have supported me, throughout. Next I shall be seriously watching Radio Stations, that refuse to play my music. It's a sham & time to speak out, over the hysteria created by the Press, in this God forsaken Country, that seems to hypnotise, the general public".

Oh, that would be absolutely brilliant!

a link I posted in another thread led me to a tale of a barrister found Not Guilty in a Perth court of murdering his wife.
Something caught my eye: he is suing detectives for defamtion (that case was put on hold because of the murder trial but now resumes) :

I think the police have acted quite disgracefully over the Savile matter : not about Savile but alleged others they claim were involved. They have been quite vocal " We are coming for you " etc etc and so on, implying guilt so that anyone arrested like GG or F. Starr look guilty when they haven't even been charged.
There is now way in the world the police could have checked the claims coming in yet...the media is bullying the police into action..

I wonder if there will be libel cases after thios is all over ?

Lack of evidence crippled prosecution case against Rayney

In the end, there was no evidence to prove prominent Perth barrister Lloyd Rayney killed his wife Corryn.
In fact, much of the prosecution's evidence was contradictory and lacked logic, Justice Brian Martin said on Thursday. The case was "beset by improbabilities and uncertainties".

A defamation case against the state over comments made by the police officer who led the Rayney investigation in 2007 - which branded Mr Rayney the "prime and only suspect" - was put on hold pending the outcome of the trial.
The comments rendered Mr Rayney the subject of "public hate" and saw him "shunned by right thinking members of the community," according to a statement of claim launched by his lawyers in 2008.

There is a further aspect to this - wasting police time.

I suggest this crime should be prosecuted more and sentenced higher (fines rather than jail).

A £10,000 fine payable at £100 a week would deter false allegations.

So shocking, so familiar, so routine, so true, so sad.

What kind of person now laughs at IT'S OWN CRIMINAL INJUSTICES ?
