Recording Deal plus Publishing? Is it the Norm? 17 Years, 6 Months ago
Hi Tipsheet,

Currently talking to a large indie label regarding a deal, they have shown an interest in signing a recording deal (my first) but want a slice of my publishing aswell.

Is this normal in the industry these days? Currently seeking legal advice but was wondering what the consensus on here was as well.

Thanks in advance.

Best Regards,

Dan

Sounds like part of the new model; these days a label simply cannot make money unless it shares some of the other revenue.

Do they also want a slice of your other revenue streams such as performances, merch etc?

Quite possibly, we were breifly talking about the new 360 model. I know it's all change at the moment, so I was a little concerned I would be giving away too much, too early, for too little. Interested to hear how other's in the industry were perceiving and putting into practice this new model (if at all).

Ideally I want my own publishing company and do an Admin deal, but I realise with profit margin's slimming down compromises have to be made to get on. Any advice, pearls of wisdom greatly received.

Thanks in advance.

the only advice you need is from a music lawyer.

highly recommend Stephen Kempner @ Sheridans or Richard Baskind @ Edge Legal

skempner@sheridans.co.uk and richard.baskind@edgelegal.co.uk

When it comes to publishing, the only thing that really gets me going is that "everywhere-forever" clause which is still often the first offer. No one has ever offered me enough of an advance to merit it - and I'm not extraordinarily demanding. Apart from that, if publishing is included as part of a good overall package, why not?

It depends what they are offering in the sign up package e.g. recording time, producer and, most importantly, promotion.

Worth noting that the official line on signing over publishing rights is, "don't".
