There are times, just occasionally, when I feel a bit bad for people that actually pay to license music.
Activision, who put together the "Guitar Hero" game, are being sued by the Romantics for the use of their song "What I Like About You" in "Guitar Hero Encore". No, it's not a copyright infringement, as the developer got clearance from them to re-record the song. What they are complaining about is that it's a copycat version, ie it sounds too much like the original! It seems just a little bit rich to me. It reminds of when [famous band] was approached by The Smurfs to do a version of [famous song], which went on to chart in a dozen countries. They subsequently sued the Smurfs as they used a sample from the original track. Given the amount of money they were making in this second career for the song, I thought it a bit strange.
So what would you do in this case if it was your track?
