but for those concerned in my wrongful convictions, here are just a dozen reasons driving specific points (all can be confirmed in the trial transcript) for my miscarriage of justice.
1) As revealed in the ANVER SHEIKH appeal, police can "lead people into making allegations and we don't know if they tell them they could get compensation" So quote Clair Curtis Thomas MP.
Oh yes we do. One of the witnesses against me revealed in the box at the Old Bailey that he'd only come forwards because his sister, reading about my arrest and charge on other (subsequently dropped) charges, had phoned him and suggested that there would be huge compensation if he made a similar complaint. He then admitted having lengthy discussions with the investigating police officer about the exact sum in compensation he might receive. That police officer, not knowing he'd spilled the beans, denied any such conversation when giving evidence.
2) That same witness said he met me when he rushed up to me in a supermarket and raved about my TV show No Limits. The problem was...the show wasn't broadcast or made until a year after that. When we proved this in court, the judge was asked to change the dates on the charge, which he did without giving me a single second to provide alternative alibis for the later time frame.
3) Likewise, another false accuser swore that I'd given him a photo of myself and Sam Fox on holiday and put my hand on his knee, causing him to rush off and never meet me again. We proved that the photo had been taken TWO AND A HALF YEARS after he claimed the incident happened. So the judge changed the dates, again without allowing me one word of defence of the later period and sent out the jury to consider the verdict.
4) I don't believe I ever even met that man, the fifth of my five "victims." So how did he obtain the photo? I can only say that several copies of it were seized when the police had raided my home months earlier. And the men had TEN visits from the police officer at his place of work...but only produced the photo after several of them. How strange!
5)One "victim" who revealed he'd fortunately escaped serious charges of being the getaway driving in a stolen car at a smash'n'grab raid on a video store. When he agreed to testify against me, had tired to sell his story to the News Of The World years earlier and they disbelieved him so much that they set him away with a flea in his ear, never even phoning me to ask if I knew him. So ludicrous were the allegations. I've been convicted at the Old Bailey of charges that the News Of The World dismissed as fiction!
6)The same man, a heroin addict, said he'd never, ever waive his anonymity or sell his story to the papers. Unsurprisingly, he popped up on the front page of The People after I was convicted, with several other pages detailing his absurd story.
7) The judge put a CONTEMPT OF COURT order on all proceedings, saying that knowledge of other claims would seriously damage my defence, but one click of the mouse on the internet would have told jurors throughout he trial about the inital, unconnected allegations. Clearly he thought a GOOGLE was a ball bowled in cricket. Or that no juror ever went on the World Wide Web.
8) By allowing the prosecution to change the dates on FOUR of the charges, the judge seriously breached my human rights which (Art 63b) specify "adequate time and facilities to prepare and present my defence." The jury were sent out without hearing one word of my defence for the later time frames.
9) And, since we proved the dates were wrong(always EARLIER. bringing down the ages of the "victims") and had numerous other claims thrown out because we'd proved the same in "legal argument," it begs the question...can it be a coincidence that witnesses constantly got the dates wrong when police interviewed them? Or was it police policy to try to lower the ages?
10) The irresponsible media coverage even printed the claims of the liars in my SECOND trial without revealing that I was found NOT GUILTY of all those allegations.
11) The SHEIKH appeal illustrates the motive of greed for compensation(up to 33,000 pounds) but doesn't touch on the media interview fees. Agents like Max Clifford can obtain HUNDREDS OF THOUSANDS (as he told Nadine Milroy Sloane when she made false allegations against The Hamiltons). But there are many other motives. Revenge (for affairs or other behaviour, in the marital home or outside); desire for attention; craving for sympathy (criminals especially know it's the only way to get sympathy...claim abuse as a child and even the worst murderer gets sympathy); genuine delusion (one of my false accusers suffered the classic symptoms of cannabis induced schizophrenia); sheer insanity...and TRAWLING, a method now totally discredited, is most effective when it's TRAWL BY MEDIA. The publicity in my case would have cost millions to purchase. No wonder it brought so many loonies out of the woodwork.
12) Tunnel vision. Police seem incapable of envisioning any other possibility than guilt and read ever sign as evidence. When they snarled at me "who's that boy?", pointing at an old Polaroid from the 60's of a teenager in swimming trunks, they were bitterly disappointed to be told it was ME!
