a man taking out a private prosecution of his wife for perjury when she falsely accused him of abusing his children.

Private prosecutions have often happened in the UK but very rare in Oz. However if a precedent is set it will affect UK law.

Everyone will be watching this with interest. I think most are so relieved if found innocent they never chase up those who lied..they should more often.

Man acquitted but loses job and home

A DAD cleared of claims he sexually abused his kids is now hitting back at his ex wife.

The man is accusing his ex-wife of perjury, assault and threatening to kill.

The legal action, believed to be a first for Victoria, will set a controversial precedent and could open the floodgates to similar cases.

mind you note the tone of the report :"hitting back" at his wife...surely should be 'regaining his trashed reputation" or similar

I think you'll find the false accusers are protected in British law.There was a recent test case in the Lords.Basically the police & CPS are responsible,because they chose to carry out the prosecution.

However the burden of proof is so low to warrant a prosecutrion these days,and sueing the authorities is both expensive,and hard going.

that explains some things as I'm not clued up on the law.

However I think this guy is prosecuting on the strength that she signed afidavits with false information which would take the case outside the area of protection.

Surely, making a false claim in court is perjury.
How can the law protect someone from prosecution for committing a criminal offence?

This is interesting and I hope the guy wins.

And if not perjury, surely a false accuser can at least be sued for slander/defamation?

If cases like this are successful - I'm thinking also of the man taking B.A. to court for treating men as paedos, then the abuse industry might finally be stopped and even reversed.

Sadly, I think there are too many powerful interests involved for that to ever happen...
