BURN MYSPACE BURN !!! 18 Years ago  
This has been circulating the Myspace bulletin boards. Is it something to worry about or has the user got the wrong end of the stick ?

Below is a paragraph taken from MySpace's "Terms of Use Agreement" (linked off the MySpace homepage.) Im no lawyer, but Im sure what it means is they can basically use your artwork / photography / music etc. without ANY permission or payment. Even going as far as sublicensing it to third parties. In other words, they can sell the rights to your work to advertisers, marketing firms etc. without your permission, because, according to them, youve already given permission by posting your stuff to their site! It also says that when you take the content off your page...copies will remain on their servers and they have rights to those copies FOREVER!

6.) Proprietary Rights in Content on MySpace.com.

By displaying or publishing ("posting") any Content, messages, text, files, images, photos, video, sounds, profiles, works of authorship, or any other materials (collectively, "Content") on or through the Services, you hereby grant to MySpace.com, a non-exclusive, fully-paid and royalty-free, worldwide license (with the right to sublicense through unlimited levels of sublicensees) to use, copy, modify, adapt, translate, publicly perform, publicly display, store, reproduce, transmit, and distribute such Content on and through the Services. This license will terminate at the time you remove such Content from the Services. Notwithstanding the foregoing, a back-up or residual copy of the Content posted by you may remain on the MySpace.com servers after you have removed the Content from the Services, and MySpace.com retains the rights to those copies. You represent and warrant that: (i) you own the Content posted by you on or through the Services or otherwise have the right to grant the license set forth in this section, and (ii) the posting of your Content on or through the Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by you to or through the Services.

Man, I knew this site was too good to be true. When the popularity of the site dies and finally goes away, their going to hold the biggest database of music and art content and make tons of money off your hard work. This sucks

My suggestion is to build your own site (or use other websites that cater to artists that dont violate your ownership) and post links to it from your MySpace page. But dont post anymore of your work to MySpaces servers.

Nah nothing to worry about. If they do steal anyones work off the site then Tom and Co at Myspace are gonna have about 15 million people ganging up on them.

As far as I know, these or similar terms are used by all of the social networking sites/blogs.


A question concerning royalties for musical compositions.

If they do steal anyones work off the site then Tom and Co at Myspace are gonna have about 15 million people ganging up on them.And if the 15 million have also agreed, what can they do?

Beat them up i suppose. What else would 15 million people do?
